State Council Passes Draft of a New Version of China’s Emission Permit Regulation

Premier Li Keqiang hosted an executive meeting of the State Council on December 9th, 2020. The meeting passed the “Regulations on the Management of Emission Permits (Draft)” (hereafter called “Draft”), clarifying that the pollutant discharge units shall be classified according to the amount of pollutants produced, discharged, and the level of impact to the environment, among others.

According to the Draft, the approval procedures for the emission permits should be standardized, and the polluting units are required to establish an environmental management inventory system, disclose the emission information. Supervision during and after the pollutants discharge will be strengthened, and the cost of violations will be increased by adopting continuous penalties on a daily basis, suspension or shutdown of production for rectification.

The new version of China’s Emission Permit Regulation will likely be released soon by China’s Ministry of Ecology and Environment (MEE). Solid waste will be a newly added parameter to be regulated in the emission permit system.
