The Climate Chapter of the Ecological and Environmental Code of the People’s Republic of China – An Assessment from the Perspective of EU and German Climate Law

The report considers the incorporation of climate-related provisions into the Ecological and Environmental Code of the People’s Republic of China an important milestone in the development of China’s climate legal framework. At the same time, the existing climate-related provisions leave scope for further refinement and improvement. More clearly defined targets, procedures and implementation mechanisms are needed to further translate these framework provisions into an effective climate governance system. The relevant experience of Germany and the EU can provide useful reference for this process, while China’s future climate legislation will need to take into account its national conditions, governance system and climate objectives. The report will also provide a reference for further strengthening climate governance, advancing the implementation of China’s Nationally Determined Contribution (NDC), and deepening Sino-German exchanges in the field of climate change.
